Woman sues Kroger for injuries

CHARLESTON — A Charleston woman is suing Kroger alleging she was injured while grocery shopping by slipping in an unknown liquid.

Sherry Browning was at the Charleston Kroger on Sept. 13 between 9 and 10 p.m. when she walked toward the deli and slipped on clear liquid, which caused her to fall, according to a complaint filed in Kanawha Circuit Court.

Browning claims she sustained injuries when she fell into the clear liquid and was unable to see the liquid on the floor.

Kroger, as the grocery store owner, knew or should have known of the dangerous liquid on the floor and taken steps to remove it or warn patrons of the liquid, according to the suit.

Browning claims the defendant was negligent because it had a legal duty to provide safe premises for patrons and failed to do so.

Browning claims Kroger violated its duty by failing to block off the area of the floor where the liquid was present and failed to warn patrons of the dangerous condition.

Kroger is liable for Browning's damages, according to the suit.

Browning claims she is entitled to damages for personal injury, medical expenses, wage loss, pain, suffering, diminution of enjoyment of life and mental and emotional distress.

Browning is seeking compensatory damages with pre- and post-judgment interest.

The case is assigned to Circuit Judge Tera Salango
