Woman sues benefits provider for terminating benefits

HUNTINGTON — An Ohio woman is suing Unum Life Insurance alleging it wrongfully terminated her long-term disability benefits.

Connie L. Rawson was employed at West Virginia University Health System's Camden Clark Medical Center in Parkersburg, according to a complaint filed in U.S. District Court for the Southern District of West Virginia.

WVUHS offered an employee welfare benefit plan, including long-term disability benefits, with the plaintiff being an eligible beneficiary.

The defendant, Unum Life Insurance Company of America, insured and administered the long-term disability benefits and the plaintiff applied for and received disability benefits from July 4, 2020, to July 29, 2022, under the WVUHS Plan. 

The defendant terminated the plaintiff's benefits arbitrarily on July 30, 2022. The plaintiff appealed this decision, providing additional evidence, but the appeal was denied on May 8, 2023.

The plaintiff claims that the defendant's actions were an abuse of discretion, arbitrary, capricious and contrary to the WVUHS Plan's terms. 

Rawson claims her entitlement to long-term disability benefits under the WVUHS Plan.

Rawson is seeking recovery of all benefits due and owing to her with pre-judgment interest. She is represented by John J. Polak of Atkinson & Frampton in Charleston.
