Couple sues Target for hazardous condition on floor

HUNTINGTON — A couple is suing Target alleging it failed to keep the flooring clear of hazardous conditions.

Mildred Facemyer went to Target in Barboursville on Aug. 14, 2022, and while in the store, she slipped on a clear substance that was present on the floor, according to a complaint filed in Cabell Circuit Court.

Facemyer claims it was later identified that the clear liquid was a bubble solution that had not been cleaned up.

The store director attended to Facemyer before she left to seek medical care and filled out a guest incident report detailing the fall.

Target was negligent in controlling and maintaining the business property, according to the suit.

Facemyer claims the defendant had a duty to provide reasonable warnings and clean up the liquid, but failed to do so.

"As a direct and proximate result of the...negligent of the defendant, Target Corporation, the Plaintiff, Midred Facemyer, was seriously and severely injured when she was caused to slip and fall due to a clear, slick substance being on the floor..." the complaint states. 

Facemyer and her husband, Vernon Facemyer, are seeking compensatory damages. They are represented by Matthew L. Clark and Kayser Layne & Clark in Point Pleasant.

The case is assigned to Circuit Judge Gregory Howard Jr.
