CHARLESTON — A Poca woman says WV Pre-Owned Auto caused her damages by not having a loaner vehicle insured.
Brandon Ferrari was also named as a defendant in the suit.
Rachel Tyler purchased a 2014 Kia Sportage from WV Pre-Owned Auto Group and noticed several weeks after the purchase that the vehicle had a "knocking" sound coming from it, according to a complaint filed in Kanawha Circuit Court.
Tyler claims she called the defendant and was told to take the vehicle to the Pennsylvania Avenue shop to be checked out and the mechanic told her it needed an axel and to be serviced.
"After receiving my car back from them, I noticed to 'knocking' was still there but louder," Tyler stated in the complaint.
Tyler claims she then spoke with Aubrey Braddock, who told her to bring the vehicle in to be serviced and leave it with them until it could be fixed. Braddock also told Tyler the defendant would loan her a vehicle until the Kia could be fixed.
Tyler claims the vehicle she was loaned was a 2015 Jeep Grand Cherokee that had bad brakes and she reached out about the issue, but no one got back to her.
On June 4, Tyler was driving on Highway 119 in the Jeep and the brakes did not stop efficiently and she rear-ended another vehicle, according to the suit.
Tyler claims the defendant then told her they didn't have insurance on the vehicle and she would be responsible for the accident.
Tyler is seeking damages for the accident. She is representing herself.
