CHARLESTON — A woman is suing ModivCare alleging she was wrongfully terminated.
ModivCare Inc. and ModivCare Solutions were both named as defendants in the suit.
Nicole Wilson was a customer service representative for the defendants beginning in early 2021, according to a complaint filed in Kanawha Circuit Court.
Wilson claims she was wrongfully terminated in March 2023 while performing her job duties in an exemplary manner.
"Defendants' actions were inherently and entirely unreasonable and discriminatory," the complaint states. "The failures and wrongful actions of Defendants as undertaken against Ms. Wilson ... are in violation of the WVHRA."
Wilson claims the wrongful and illegal conduct of the Defendants has damaged her.
Wilson claims the defendants wrongfully terminated her employment in a retaliatory and wrongful manner.
Wilson claims there was no reasonable justification for her termination and that she suffered lost wages and benefits due to her termination.
The defendants have a duty to employees to hire and retain competent employees, including supervisors, according to the suit.
Wilson is seeking compensatory and punitive damages. She is represented by Shawn R. Romano and Miles B. Berger of Romano & Associates in Charleston.
The case is assigned to Circuit Judge Kenneth Ballard.
