HUNTINGTON — An Ohio woman says she was injured while shopping at Menards.
Menard Inc. and Menards Barboursville both were named as defendants in the suit.
Ida Adkins was at Menards on Oct. 11, 2021, when she fell due to a grossly negligently placed low stack of carpets/rugs/mats at the end of a shopping aisle creating a tripping hazard, according to a complaint filed in Cabell Circuit Court.
Adkins claims there were no warnings placed around the tripping hazard before the fall and the fall hazard was not open and obvious to her.
The defendants negligently maintained the premises and failed to keep the premises in a safe manner, according to the suit.
Adkins claims the defendants failed to fix any hidden dangers and/or defects on their property and failed to warn patrons of the defects.
Adkins claims she sustained medical expenses, loss of household services, loss of earning capacity, and lost wages and benefits.
"Defendants are liable to the Plaintiff for all injuries and damages proximately caused by the Defendants..." the complaint states.
Adkins is seeking compensatory and punitive damages. She is represented by Nathan J. Chill and Kevin P. Davis.
