Former employee says WorkForce West Virginia violated wage payment law

CHARLESTON — A Kanawha County man is suing WorkForce West Virginia alleging it failed to pay his final wages after he left his employment.

Mike Idleman was the assistant director of Unemployment Compensation with WorkForce West Virginia until April 21 and he claims the defendant failed to pay his wages due by the next regular payday, according to a complaint filed in Kanawha Circuit Court.

Idleman claims the defendant violated the West Virginia Wage Payment and Collection Act by failing to pay wages that were due and owing.

Idleman claims he is entitled to liquidated damages at two times the amount of unpaid wages.

"As a direct and proximate cause of Defendant WorkForce West Virginia's numerous breaches of their statutory duties, as set forth throughout this complaint, Plaintiff Idleman suffered and continues to suffer damages," the complaint states. 

WorkForce West Virginia's violation of the West Virginia Wage Payment and Collection Act, Idleman has lost income and benefits and has suffered and will continue to suffer humiliation, embarrassment, mental and emotional distress, loss of personal dignity and inconvenience, aggravation and annoyance, according to the suit.

Idleman claims the defendant acted negligently, recklessly and/or with willful and wanton disregard.

Idleman is seeking compensatory and punitive damages. He is represented by James M. Pierson of Pierson Legal Services in Charleston. and 

The case is assigned to Circuit Judge James Rowe.
