Property owner sues Italian Grille & Deli for failing to pay rent

WINFIELD — Hauppauge Properties is suing Italian Grille & Deli alleging it breached its contract by failing to pay its rent payments.

Timothy Eplion II was also named as a defendant in the suit.

Hauppauge Properties' predecessor-in-interest entered into a real estate contract for 18 months with Italian Grille & Deli in 2008, a lease that continued to be renewed several times, according to a complaint filed in Putnam Circuit Court.

Hauppauge claims the lease was renewed in February 2022 for a five-year term, however, the defendants have failed to perform their obligations by failing to make rent payments.

On June 7, the defendant agreed to pay $20,000 toward its $76,225.93 balance and the plaintiff agreed to waive late fees, however, the defendants again fell behind on making rent payments, according to the suit.

Hauppauge claims the defendants now owe $88,314.32 for past due rent and $227,278.04 in future rent pursuant to the lease. It claims the defendants breached their contract.

The plaintiff alleges it is entitled to the right of re-entry into its property and that the time for the defendants to vacate the property has lapsed.

Hauppauge is seeking compensatory damages. It is represented by Eric S. Embree of Tyree, Embree & Associates in Hurricane.
