Former employee syes Blackstone Energy for settlement breach

PINEVILLE — A former employee is suing Blackstone Energy for failure to abide by a settlement order.

Blackstone Energy, Sammy Ray, Bluestone Coal Company and James T. Miller were all named as defendants in the suit.

James Hoosier was fired from his job with the defendants after he made safety complaints, who he alleged demanded the operation of a commercial vehicle on public roads without proper permits, insurance and in poor repair, according to a complaint filed in Wyoming Circuit Court.

Hoosier claims he refused to operate illegally due to concerns about his Commercial Driver’s License (CDL) and potential harm. 

Hoosier filed a lawsuit against the defendants and in April 2022, settlement was reached where Hoosier would receive a confidential cash payment and return to work. 

Despite Hoosier meeting all terms, Defendants failed to pay the settlement, according to the suit.

Hoosier claims the defendants breached their contract, which has caused monetary loss, emotional pain, inconvenience and harm to Hoosier's personal and professional reputation.

Hoosier claims he relied on the defendants' promises and suffered substantial financial loss and damages.

Hoosier is seeking damages. He is represented by D. Adrian Hoosier II of Hoosier Law Firm in Charleston.
