Woman sues Yes Chevrolet for alleged defective vehicle

WINFIELD — A woman alleges she purchased a defective vehicle from Yes Chevrolet.

Transportation Network VII Inc. is doing business as Yes Chevrolet.

Peoples Bank was also named as a defendant in the suit.

Sherri Faudree purchased a 2019 Hyundai Elantra SE from Yes Chevrolet on Aug. 20, 2022, according to a complaint filed in Putnam Circuit Court.

Faudree claims after the purchase, she discovered substantial nonconformities and defects that impaired the use and value of the vehicle, including transmission defects.

"Plaintiff could not reasonably discover the nonconformities and defects at the time of purchase because they were difficult to discover and because of the warranties, representations, promises and assurances made by Yes' representative," the complaint states.

The plaintiff does not have the resources to repair and remedy all of the non-conformities and defects and the defects substantially impair the use and value of the vehicle, according to the suit.

Faudree claims the defendants breached the implied warranties of the vehicle.

"Yes intentionally or recklessly failed to disclose the unmerchantable character and nature of the vehicle, representing instead that the vehicle was fit for the ordinary purposes for which such vehicles are used," the complaint states.

Faudree is seeking compensatory damages with interest. She is represented by J. William St. Clair in Huntington.
