Woman sues Charleston for pothole that caused injury

CHARLESTON — A woman is suing the City of Charleston alleging she was injured when she fell into a pothole.

Brenda Honaker claims she parked near 805 Grant Street in Charleston on Nov. 16, 2021, as she was transporting her minister to an appointment, when her left foot went into a deep pothole, according to a complaint filed in Kanawha Circuit Court.

Honaker claims she did not see the deep pothole adjacent to the sidewalk, as it had been filled with black water and was not clearly visible to pedestrians.

The plaintiff was carrying her minister's walker when her foot went into the pothole and fell forward, landing on both of her knees and causing severe and permanent injuries, according to the suit.

Honaker claims she fractured her ankle in the fall. She claims the defendant was negligent in not repairing the pothole.

The defendant negligently failed to maintain its streets in a reasonably safe condition, in good repair and free from nuisance and hazard, according to the suit.

Honaker is seeking compensatory and general damages with pre- and post-judgment interest. She is being represented by J. Kristofer Cormany of Cormany Law in Charleston.

The case is assigned to Circuit Judge Tera Salango.
