HUNTINGTON — A couple is suing another man and a construction company for damage done to their property due to a landslide.
Paul King, Dunright Construction and Renovation Company were all named as defendants in the suit.
Dunright Construction is doing business as Kingdom Builders.
In May 2023, the hillside behind the property of Tim Millne and Diana Millne failed, resulting in a massive landslide, according to a complaint filed in Cabell Circuit Court.
The Millnes live on Ritter Boulevard, which has lots adjacent to Old Snake Road. King is the owner of Old Snake Road and has gates placed at either end of Old Snake Road.
King failed to properly maintain Old Snake Road and failed to control water runoff. He also failed to install and/or maintain proper drainage and failed to prevent and repair slippage of the road and hillside, according to the suit.
The Millnes claim Dunright negligently attempted to repair the slip by placing construction debris in the area of the slip, however, the resulting landslide then destroyed their backyard.
The area continues to move and is only feet from the Millne residence, according to the suit.
The Millnes claim the cost to remove and repair the landslide exceeds the value of the plaintiffs' home and has caused them to suffer annoyance, aggravation and inconvenience.
The Millnes are seeking compensatory damages. They are represented by Michael C. Walker of Greene Ketchum Bailey & Tweel in Huntington.
The case is assigned to Circuit Judge Paul T. Farrell.
