Man sues contractor for work injuries

CHARLESTON — A Kanawha County man is suing Gorsuch Construction Inc. claiming he was injured on a job site.

Joshua Hunt was a sub-contractor on a construction site in St. Albans that was under the supervision and control of Gorsuch, according to a complaint filed in Kanawha Circuit Court.

Hunt claims on Nov. 13, 2021, he was working at the bottom of an elevator shaft when employees of the defendants dropped items on Hunt, causing him injury.

Hunt claims he was struck by a 2x4 and immediately felt pain in his right shoulder, but continued working. Several days later, he sought medical attention and learned he had a fractured scapula.

The defendant was negligent for failing to keep Hunt safe and breached its duty of care owed to him, according to the suit.

"As a direct and proximate result of Defendant's negligence, Plaintiff...suffered injuries, incurred medical expenses, experienced pain and missed work," the complaint states.

Hunt claims some of his injuries were severe and permanent.

Hunt is seeking compensatory damages with pre- and post-judgment interest. He is represented by Jonathan R. Mani of Mani, Ellis & Layne in Charleston.

The case is assigned to Circuit Judge Tera Salango.
