Moses Automall of Huntington sues Cadillac Global for failure to deliver goods

HUNTINGTON — Moses Automall of Huntington is suing Cadillac Global claiming it has failed to deliver car parts.

Moses claims beginning in June 2022, it contacted the defendant to inquire about purchasing various car parts to restore a 1970 Cadillac Deville, according to a complaint filed in Cabell Circuit Court.

Moses claims it wanted to restore the vehicle for advertising purposes and the parties agreed and executed three purchase orders for various parts.

Under the terms of the agreements, the plaintiff agreed to pay $42,944.36 to the defendant for the parts, which were supposed to be delivered in August 2022.

Moses claims it has never received the parts it paid for and has called the defendant more than one dozen times since August 2022 regarding the car parts.

The defendant continues to offer various excuses as to why the parts have yet to be delivered and by July 2023, the defendant had stopped responding to correspondence regarding the parts, according to the suit.

Moses claims the defendant breached its contract and has been unjustly enriched at Moses' expense.

Moses is seeking monetary, incidental and consequential damages. It is represented by Anders W. Lindberg and Mattie F. Shiler of Steptoe & Johnson in Huntington.

The case is assigned to Circuit Judge Alfred E. Ferguson.
