Estate sues WVU Board of Governors for medical negligence

CHARLESTON – A man's estate has sued the West Virginia University Board of Governors for alleged medical negligence.

Misty Potts, administrator of the estate of Jerome Potts, filed her complaint in federal court against the BOG and Dr. Dustin Spencer.

According to the complaint, negligence led to Jerome Potts' death on November 17, 2021. He had sought medical care at WVU Medicine Camden Clark Medical Center on October 31, 2021, for flank pain, nausea and vomiting following a hip replacement surgery he underwent a month earlier.

Despite showing signs of fever and elevated troponin levels indicating potential heart problems, Potts' attending physicians failed to provide adequate care, according to the complaint. It also claims these oversights and omissions directly contributed to Jerome's untimely death.

The complaint accuses the defendants of medical professional liability and wrongful death.

The estate seeks compensatory damages, punitive damages, pre- and post-judgment interests, court cost, attorney fees and other relief.

The plaintiff is being represented by Steven K. Nord and Ryan Q. Ashworth of Ashworth Nord in Huntington.
