Man sues company after he was injured in forklift accident

A couple blames Builders FirstSource after the husband was injured in a forklift accident.

Jason Eric Randolph and Sarah Beth Randolph filed their complaint in Kanawha Circuit Court against Builders FirstSource, which is based in Dallas, Texas.

According to the complaint, Jason Randolph was working at a job site in Barboursville on December 3, 2021, as an employee of Hayes Brothers Construction when an employee of Builders FirstSource negligently operated a forklift causing the load to fall on him. 

As a result of this incident, Jason Randolph says he sustained serious injuries leading to great pain and suffering, loss of enjoyment of life, lost wages in the past and will continue to suffer loss of income and/or a diminution in his earning capacity.

The complaint says Builders FirstSource had a duty to educate, train and inform its employees about the proper use of any equipment used during their daily job responsibilities. The plaintiffs are seeking damages in excess of $60,000 for lost wages and more than $169,000 for medical bills incurred due to Jason's injuries.

Sarah Beth Randolph also claims she has suffered from the loss of society, companionship, comfort, guidance and consortium due to her husband's injuries.

The plaintiffs seek compensatory damages, pre-judgment interest and costs.
