Women say wheels from passing vehicle hit their car

WELLSBURG – Two Northern Panhandle women say wheels detached from a passing truck struck their vehicle causing injury and damages.

Rebecca Kubacka of Wheeling and Betty Palmer of Wellsburg filed their complaint in Brooke Circuit Court against JP Graham Transport, D&I Leasing, Charlest Egenlauf and John Doe defendants. Palmer is Kubacka’s mother-in-law.

According to the complaint, Kubacka and Palmer were driving northbound on W.Va. 2 on their way to work January 6, 2022, when a 2000 International power unit towing a 1994 Trao trailing unit driven by Egenlauf was traveling south when a set of dual wheels that had been improperly attached to the defendants’ trailer hit their vehicle after traveling across the median at a high rate of speed.

The incident caused severe and permanent injuries to the plaintiffs as well as pain and suffering, mental anguish, loss of enjoyment of life, embarrassment, inconvenience, medical bills, lost wages and other economic and noneconomic damages.

The plaintiffs accuse the defendants of negligence and negligent infliction of emotional distress. They seek joint and several compensatory damages, punitive damages, pre- and post-judgment interests, court costs, attorney fees and other relief.

They are being represented by Teresa Toriseva and Joshua Miller of Toriseva Law in Wheeling. The case has been assigned to Circuit Judge Michael Olejasz.
