Jackson County woman files medical negligence lawsuit

PARKERSBURG – A Jackson County woman is accusing a Wood County medical facility and two physicians of negligence.

Patricia Locker filed her complaint January 18 in Wood Circuit Court against Dr. Bairava Kuppuswamy, Dr. Terry Shank and Parkersburg Radiology Inc.

According to the complaint, Locker was admitted to Camden Clark Medical Center in Parkersburg on July 28, 2020. Kuppuswamy ordered a CT chest without IV contrast for her, and radiologist Shank noted a nodule in her lung that had increased in size. Shank recommended a follow-up CT in six months.

But there is no record indicating Kuppuswamy followed the recommendation for the follow-up CT, according to the complaint.

On November 29, 2021, Locker received another CT that revealed a mass in her right lung was suspicious for cancer. Following a biopsy, Locker was diagnosed with adenocarcinoma on December 21, 2021. It was staged at IIIA.

Locker accuses both doctors of professional negligence and Parkersburg Radiology of medical negligence.

She seeks compensatory damages for medical expenses, pain and suffering, loss of earnings, annoyance, embarrassment, humiliation, inconvenience and loss of enjoyment of life. She also seeks punitive damages, pre- and post-judgment interests, attorney fees, court costs and other relief.

Locker is being represented by L. Dante diTrapano and David H. Carriger of Calwell Luce diTrapano in Charleston and by Richard D. Lindsay and Richard D. Lindsay II of Tabor Lindsay & Associates in Charleston.
