CHARLESTON – A Cabin Creek woman has sued after falling at a local public service district office.
Sharon Kennedy filed her complaint in Kanawha Circuit Court against the Kanawha Public Service District.
According to the complaint, Kennedy was visiting the office in Cabin Creek on December 21, 2021, when she tripped over an unseen rise at the entrance door's threshold. Kennedy injured both of her legs.
She claims the entrance which had no warning signs or paint indicating the presence of the rise. She alleges the PSD was negligent in maintaining safe walking surfaces, failed to provide adequate warning signs or paint warnings and created a hazardous condition for visitors to the premises.
Kennedy seeks compensatory damages, punitive damages, court costs and other relief.
She is being represented by Charleston attorney Kevin P. Davis. The case has been assigned to Circuit Judge Kenneth Ballard.
