Man says Jeep he purchased was defective

CHARLESTON – A Kanawha County man says a Jeep he purchased was defective.

Cyrus Barton III filed his complaint in Kanawha Circuit Court against FCA US LLC and Dutch Miller of Charleston Inc.

According to the complaint, Barton purchased a 2014 Jeep Grand Cherokee from Dutch Miller on July 5, 2015. He says the vehicle has had serious mechanical nonconformities and defects since the purchase that he says should be covered by warranty.

Barton claims the defendants fraudulently misrepresented the condition of the vehicle and its warranty coverage, breached their warranties, refused to remedy the problems, committed unfair or deceptive acts or practices and violated other laws. As a result of these alleged actions, Barton says he suffered monetary loss, emotional distress, aggravation, anxiety, loss of use, annoyance, and inconvenience.

He seeks compensatory damages and equitable relief under the West Virginia Consumer Credit and Protection Act, the Uniform Commercial Code and applicable state common law.

Barton is being represented by Kristina Thomas Whiteaker of The Grubb Law Group in Charleston. The case has been assigned to Circuit Judge Tera Salango.
