Woman sues after slipping on black ice in Lowe's parking lot

CHARLESTON – A Putnam County woman says she was injured when she slipped on black ice in the Lowe's parking lot.

Marilyn Clark of Hurricane filed her complaint January 2 in Kanawha Circuit Court against Lowe's Home Centers Inc., The Nitro Development Limited Liability Company and Scary Creek Lawn Care LLC.

According to the complaint, Clark went to the Lowe's at Nitro Market Place in Cross Lanes on February 1, 2023. Weather conditions had created black ice on the parking lot. When she stepped out of her Jeep Wagoneer, Clark says she slipped and fell. She says her left shoulder hit the running board of the vehicle, and her buttocks hit the pavement.

Clark injured her left shoulder, ultimately requiring a fusion a week after the incident. She also sustained soft tissue injuries and left arm weakness.

She seeks compensatory injuries for her injuries, medical expenses, pain and suffering, mental pain and suffering, permanent physical impairment, lost wages and benefits, lost future earning capacity and benefits as well as lost capacity to enjoy life.

Clark is being represented by David A. Bosak of Bailey Javins & Carter in Charleston. The case has been assigned to Circuit Judge Carrie Webster.
