CHARLETSON – A Mason County couple says the husband's cancer was caused by water contaminated with C8.
David and Sheila Washington filed their lawsuit in federal court against E.I. du Pont de Nemours and Company and The Chemours Company.
According to the complaint, David Washington resided and/or worked in at least one of the contaminated water districts including, but not limited to, Mason County Public Service District, starting in, about or before 1979 and consumed water contaminated with C-8 at greater than .05 ppb for at least one year prior to December 3, 2004.
DuPont owned and operated a manufacturing facility in Wood County known as the “Washington Works Plant” until at least 2015. The complaint says DuPont released chemicals, including C8, from the plant into the water supply.
David Washington was diagnosed with testicular cancer on January 5, 2022. The plaintiffs maintain this diagnosis is a direct result of consuming water contaminated with C8 for at least one year prior to December 3, 2004.
The couple seeks equitable relief, compensatory and punitive damages, court costs and other damages.
The Washingtons are being represented by Clayton J. Fitzsimmons of Fitzsimmons Law in Wheeling; by Jon C. Conlin, F. Jerome Tapley, Mitchell Theodora and Brett Thompson of Cory Watson in Birmingham, Alabama; and by Richard W. Schulte of Wright & Schulte in Vandalia, Ohio.
