Boone Co. man says new Silverado he bought was defective

A Boone County man claims the new Chevrolet Silverado 2500 he purchased was defective.

Kenneth Gibson filed his lawsuit in Kanawha Circuit Court against General Motors LLC.

According to the complaint, Gibson purchased the Silverado at Daniel Chevrolet in Whitesville. He says he has taken the truck back to the dealership at least seven times, but he says it still does not conform to the manufacturer's express warranties.

As a result of this alleged negligence and misconduct by the automaker, Gibson says he has suffered monetary loss, severe emotional and mental distress as well as inconvenience.

Gibson seeks declaratory and injunctive relief under the West Virginia Consumer Credit and Protection Act, the Uniform Commercial Code and the Magnuson-Moss Warranty Act. He also seeks compensatory damages, punitive damages, pre- and post-judgment interests, court costs, attorney fees and other relief.

He is being represented by Charles M. Love IV of The Love Law Firm in Charleston. The case has been assigned to Circuit Judge David Hardy.
