Stuart questions Biden's qualifications to be on W.Va. ballot

CHARLESTON – A state Senator and candidate for state Attorney General is questioning President Joe Biden’s qualifications for candidacy on the West Virginia ballot.

Mike Stuart (R-Kanawha) issued a press release February 12 calling for “a thorough review” of Biden’s qualifications for re-election. Stuart also was a U.S. Attorney and the West Virginia co-chairman of Trump's 2016 presidential campaign.

Stuart said he is introducing a formal resolution this week regarding Biden’s qualifications to stay on the West Virginia ballot.

“Biden’s ongoing invasion and insurrection on the nation’s border and the Special Counsel’s report citing serious cognitive and competency issues demands we assess President Biden’s qualification to remain as President or serve a second term,” said Stuart, also a former U.S. Attorney. “President Biden’s incitement and invitation for the invasion of at least eight million illegal migrants at the southern border is a legitimate and real insurrection.

“The 14th Amendment bars from office anyone who took an oath to uphold the Constitution but then engaged in insurrection against it. President Biden invited the border crisis, incited the border crisis, and has refused to uphold the Constitution.”

Former President Donald Trump's campaign has been the focus of similar questions by Democrats across the country. The Colorado case seeking to remove Trump from that state's primary ballot currently rests with the U.S. Supreme Court.

Stuart also is calling for an immediate examination of Biden's competency following comments made by a special counsel regarding Biden’s substantial cognitive problems.

“President Biden clearly has serious cognitive challenges that risk the national security of all Americans,” Stuart said. “He controls the nuclear codes. He has the unilateral power to order missile launches and military assaults on allies and enemies and to compel our sons and daughters to war.

“It is absolutely imperative that an immediate assessment of President Biden’s cognitive skills be assessed, and a determination made as to his competency to continue to serve as the Commander in Chief and leader of the free world.”

Others have mentioned similar concerns with Trump as well, but West Virginia Democratic Party Chairman Mike Pushkin said Stuart might be the one who needs a competency test.

“Mike Stuart's increasingly bizarre behavior should have all West Virginian's concerned about his own fitness for office,” Pushkin, who also is a House of Delegates member, told The West Virginia Record. “Just last year, he prevented a bill that would have outlawed child marriages in West Virginia from passing out of the Judiciary Committee. And now he's confusing asylum seekers with insurrectionists.

“On top of that, last week he introduced a bill to send West Virginia taxpayer dollars to Texas, one of the richest states in the country, to help them with border security. Here I thought Mexico was supposed to pay for the wall.

“Meanwhile, we have 1,500 empty teaching positions in West Virginia, our prisons are being staffed by National Guard troops because we can't pay corrections offers enough to keep them, and we have a backlog of abuse and neglect cases because West Virginia doesn't hire enough CPS workers. If anyone should be required to take a competency test, it's Mike Stuart.”

After a 15- month investigation into Biden’s mishandling of classified documents while he was in the U.S. Senate and Vice President, Special Counsel Robert Hur did not recommend criminal charges for mishandling classified documents, saying Biden would be difficult to convict while describing him as a "well-meaning, elderly man with a poor memory."

Stuart cites the 25th Amendment of the U.S. Constitution, which provides a mechanism for the removal of a president who is deemed unfit to carry out the duties of the office.

“This is not a game,” Stuart said. “This is not about partisan politics. This is about the national security and safety of every American. The insurrection at the border coupled with President Biden’s serious cognitive decline is an imminent threat to our national security at a time when chaos reigns across the world.

“It is our duty to explore all avenues available to ensure that our country is led by a capable and responsible leader.”
