Woman sues after slipping on ice at Vista View Apartments

CHARLESTON – A woman says she slipped and fell on an icy sidewalk outside of Vista View Apartments.

Tiffany Winter filed her complaint in Kanawha Circuit Court against Ten South Management Company LLC and Vista View Apartments LP.

According to the complaint, Winter lived at Vista View on January 21, 2022, when she was walking to the bus stop for work. She says the main sidewalk leading to the bus stop was not salted and had visible patches of ice.

Winter says she fell because the sidewalk was not maintained and says no warning signs were in place to alert residents of the slipping hazard.

She accuses the defendants of gross negligence.

Winter seeks compensatory damages, special damages, general damages, punitive damages, pre- and post-judgment interests, court costs, attorney fees and other relief.

She is being represented by Nathan J. Chill of Poca and Kevin P. Davis of Charleston. The case has been assigned to Circuit Judge Kenneth Ballard.
