Brian Hodge sues Synergy Inspections for abrupt termination without proper notice

Brian Hodge, on behalf of himself and others similarly situated, has filed a class action lawsuit against Synergy Inspections, LLC and FIRMSO, LLC in the United States District Court for the Southern District of West Virginia. The case number is 5:24-cv-00177 and it was filed on April 5, 2024.

The plaintiff alleges that he and other employees were abruptly terminated by the defendants on March 15, 2024. The defendants are accused of failing to provide a 60-day "WARN" Act notice prior to termination.

Hodge argues that there were no "unforeseen business circumstances" that necessitated such immediate termination without notice. He also asserts that the number of employees affected by this action meets the numerosity requirement of Rule 23.

The plaintiff seeks judgment for violation of the WARN Act, which requires employers to provide advance notice of mass layoffs. He proposes a class definition of "all employees of each Defendant, at any work site or location in West Virginia, who were entitled to and did not receive proper WARN notice”.
