Leslie Telek sues Weirton Medical Center for data breach

In the United States District Court for the Northern District of West Virginia, Leslie Telek, individually and on behalf of all others similarly situated, has filed a class action lawsuit against Weirton Medical Center, Inc. The case, identified as 5:24-cv-00069-TSK, was filed on April 10, 2024. The plaintiff alleges that the defendant suffered a cyberattack and data breach which led to unauthorized access to sensitive patient data.

The lawsuit details that approximately 27,000 individuals were affected by this breach. Personal information such as names, social security numbers, dates of birth, medical information and health insurance details were compromised. The plaintiff argues that the defendant failed to adequately safeguard this private information and did not provide timely notice about the breach.

Telek is seeking redress for the losses suffered due to this breach which include out-of-pocket expenses incurred to mitigate the effects of the attack and emotional distress caused by the compromise of their sensitive personal information. The lawsuit also points out that those affected are at an increased risk of identity theft and fraud.
