Wesley Hanson sues Senior Trooper D.M. Goodman for violation of constitutional rights

In the United States District Court for the Northern District of West Virginia, plaintiff Wesley Hanson has filed a lawsuit against Senior Trooper D.M. Goodman, with the court case ID 1:24-cv-00031-TSK on March 28, 2024. The lawsuit alleges violations of Hanson's Constitutional Rights under the First and Fourth Amendments pursuant to 42 U.S.C. §1983.

Represented by J. Morgan Leach and the J Law Firm, Hanson claims that he was subject to a traffic stop conducted by Goodman on June 8, 2023. During this encounter, it is alleged that Goodman escalated the situation by using profanity and accusing Hanson of lying about his vehicle violations.

Hanson further asserts that Goodman's intent was to issue a citation as retaliation for Hanson attempting to explain his alleged violations. After receiving the citations, Hanson tore them up and placed them in his vehicle which resulted in Goodman demanding he step out of his vehicle and subsequently arresting him.

The plaintiff seeks judgment for violation of his constitutional rights under the First and Fourth Amendments and requests compensation for damages incurred as well as attorney’s fees pursuant to 42 U.S.C. §1988.
