In the United States District Court for the Southern District of West Virginia, Robert Hanley has filed a civil action lawsuit against Otha Ray Adkins. The case, identified as 5:24-cv-00198, was lodged on April 16, 2024. Hanley's legal representation includes Eric T. Chaffin, Patrick C. Booth, Justin D. Joseph, and Chaffin Luhana LLP.

Hanley alleges that on February 20, 2023, while stopped at a red traffic signal at the intersection of Robert C. Byrd Drive and Dunn Drive in West Middlesex, Pennsylvania, his vehicle was rear-ended by Adkins who was driving a U-Haul owned Chevy Cargo Van at high speed. The impact resulted in severe injury and damage to Hanley's person and his 2022 GMC Sierra.

The plaintiff asserts that Adkins' negligence led to the accident due to multiple failures including maintaining clear distance ahead, heeding a steady red traffic signal, braking properly, observing the path of the vehicle adequately among others. Hanley suffered serious bodily injuries such as cervical radiculopathy requiring nerve block injection and muscle contraction to middle finger and thumb on his right hand along with other physical manifestations.

Hanley is seeking compensation for pain and suffering which continues indefinitely into the future; substantial reduction in his ability to enjoy life; inability to engage in normal activities; incurred medical charges including hospitalization and prescription medication; future medical expenses which are presently indeterminable; other necessary expenses; disability; disfigurement; scarring and other physical manifestations of life-altering injury caused by Adkins' negligence.
