Former Barboursville police officer says he was wrongfully terminated

HUNTINGTON – A former Barboursville police officer accuses the village of wrongful termination.

Bradwick G. Simmons filed his complaint in federal court against the Village of Barboursville.

According to the complaint, Simmons began working for the village as an officer in November 2009. He claims he was fired from his position in July 2023 after reporting illegal and wrongful conduct by other members of the Village of Barboursville Police Department. 

The alleged misconduct includes officers conducting personal business while on duty and being paid by the Village of Barboursville. Simmons also alleges upper-level officers and personnel failed to take action regarding such misconduct, which he claims is itself unlawful. The complaint does not include further details about the alleged misconduct by other officers and personnel.

The complaint accuses the village of violating the state Whistle-Blower Law and of wrongful termination.

Simmons seeks reinstatement, full payment of back and future wages, compensatory damages for annoyance and inconvenience, interest, court costs, attorney fees and other relief.

He is being represented by Michael J. Del Guidice of Charleston.
