Family estate sues United States of America for negligent healthcare services leading to death

Betty Barnett, as Administratrix of the Estate of Christina Barnett, has filed a lawsuit against the United States of America in the United States District Court for the Southern District of West Virginia. The case, identified as 2:24-cv-00232, was filed on May 3, 2024. The complaint alleges that negligent healthcare services provided by the defendant resulted in Christina Barnett's death.

The plaintiff, represented by counsel, is pursuing this case under the Federal Tort Claims Act. The document details that Christina Barnett died on April 29, 2022 from a hemorrhagic stroke caused by negligence from the defendant's side. It also mentions Betty Barnett being appointed as Administratrix of Christina's estate on April 17, 2023.

The lawsuit further claims that agents and employees of the defendant provided negligent healthcare services to Christina at Cabin Creek Health Center in Kanawha County, West Virginia. This alleged negligence is claimed to be a direct cause of Ms. Barnett’s death.

The plaintiff alleges that the Betty Barnett was diagnosed with DVT (Deep Vein Thrombosis) and was prescribed Warfarin (5mg) and discharged from the hospital on March 16th, 2022.  After a few other appointments on March 28th, 2022 Ms. Barnett's Warfarin prescription was increased to 6.5mg per day but she was told to "skip that days" dosage by her doctor. On April 15th, 2002 at 3:00 p.m. EMS was dispatched to the home of Ms. Barnett where she was vomiting and only semi responsive.  Tests revealed that she has suffered a pontine intracranial hemorrhage.  On April 29th, 2022 Ms. Barnett was pronounced dead from another hemorrhagic stroke.

The plaintiff's estate allege that the defendants were negligent in their treatment and failed to monitor Ms. Barnett's PT/INR for prescribed Warfarin.  They also failed to follow up and appropriately monitor Ms. Barnett. 

The plaintiff seeks judgment against the United States of America for its alleged negligence leading to Christina Barnett's death. She demands accountability for the damages incurred due to this incident.
