Kara DeRito accuses John Doe and insurance companies of negligent misconduct

In a recent court filing, plaintiff Kara DeRito has lodged a lawsuit against defendants John Doe, Safeco Insurance Company of America, and Liberty Mutual Insurance Company. The case was filed in the Circuit Court of Kanawha County, West Virginia with the case ID 24-C-196 on February 23, 2024.

Represented by attorney Dan Snuffer, DeRito alleges that an unknown driver, referred to as John Doe, negligently and recklessly operated his vehicle causing it to collide with her car. This incident resulted in both property damage and personal injuries to the plaintiff. The defendant fled the scene post-collision. Additionally, the insurance companies are implicated as they issued Policy No. K3593555 which is subject to this uninsured motorist claim.

The plaintiff seeks judgment for severe injuries and damages incurred including past and future medical expenses, lost wages, physical pain and suffering, loss of enjoyment of life and property damage. She also seeks punitive damages permissible under West Virginia law based on John Doe's reckless misconduct.
