Woman says she was injured while shopping at West Side Kroger

CHARLESTON – A St. Albans woman says she was injured while shopping at the Kroger store on Charleston’s West Side.

Dannita Jolly filed her complaint May 22 in Kanawha Circuit Court against The Kroger Co. and Kroger Limited Partnership I.

According to the complaint, Jolly had taken a client from her work shopping at the store on Delaware Avenue on January 15. While checking out, she says she tripped backward over a case of water that had been left on the ground. She says she fell backward and slammed her head on the floor.

She says was transported to Thomas Memorial Hospital’s emergency department and required extensive medical treatment for cervical spine pain, upper thoracic back pain, traumatic head injury and neck pain.

Jolly also says she received no assistance from any employee or supervisor at the store.

She accuses the defendants of negligence and premises liability. She seeks compensatory damages, attorney fees, court costs and other relief.

Jolly is being represented by Cary of Cary Law Office in Charleston. The case has been assigned to Circuit Judge Kenneth Ballard.
