Pharmacist says he was victim of age discrimination

ELKINS – A fired Randolph County pharmacist says he was a victim of age discrimination.

Patrick Jason Bosley of Elkins filed his complaint May 22 in Randolph Circuit Court against Davis Memorial Hospital Inc., Davis Health System Inc., CPS Solutions LLC and CAMC Health Network LLC doing business as Vandalia Health Network.

According to the complaint, Bosley was hired as a pharmacist by Davis Memorial Hospital in May 1995. In April 2019, he was promoted to director of Pharmacy Services for Davis Health System through CPS. He held that position before Davis Health System became part of Vandalia Health on March 21, 2024.

That’s the day Bosley says he was terminated from his position. He says CPS sent him a letter indicating he was terminated for violating company policy, but he says the letter did not specify what company policy was violated.

In an April 19, 2024, decision by Workforce West Virginia, it was determined Bosley violated the defendants’ Code of Conduct, Anti-Discrimination and Anti-Harassment policies. Bosley denies those allegations and says the employer provided no evidence he violated such policies or committed misconduct.

Bosley believes he was one of the oldest pharmacists working in the Davis Health System and that his duties were assumed by substantially younger people. He says his firing was part of a pattern and practice of discriminating against employees based on their age.

He says he was replaced by Allison Channell, who he believes is about 35 years old. Bosley also says Channell made allegations against him the defendants used as part of their justification in firing him.

Bosley accuses the defendants of age discrimination in violation of the West Virginia Human Rights Act and violation of substantial West Virginia public policy.

He seeks compensatory damages, general damages for front pay and back pay as well as lost benefits, punitive damages, consequential damages, incidental damages, pre- and post-judgment interests, attorney fees, court costs and other relief.

Bosley is being represented by South Charleston attorney John Einreinhofer.
