Hotel consulting company sues Glade Springs resort operator for nonpayment

BECKLEY – A company that provides consulting services to hotels has sued a company associated with the Resort at Glade Springs.

Hotel Aset Value Enhancement Inc. filed its complaint March 12 in Raleigh Circuit Court against Glade Acquisitions LLC.

The plaintiff, also known as HAVE, is based in Rhode Island. The defendant operates the Resort at Glade Springs, which is owned by U.S. Sen. Jim Justice and his family. The Justice family has owned the Resort at Glade Springs, which is located in Daniels in Raleigh County, since 2010.

HAVE’s website says it is “the leading hotel real estate asset manager and advisor in the hospitality industry” “solely focused on enabling our clients to reach their most ambitious goals.”

According to the complaint, the parties contracted for HAVE to provide and perform consulting services to Glade Acquisitions regarding the Resort at Glade Springs. The contract, which is attached to the complaint, is signed by HAVE CEO and founder Michelle Russo and by Glade Executive Vice President and General Counsel Steve Ball, whose email is listed for Bluestone Coal, another company owned by Justice and his family.

HAVE says the costs of the services provided and performed, plus reimbursable travel costs, totaled $76,004.95. But it says Glade Acquisitions has failed or refused to pay the amount.

It seeks compensatory damages as well as more than $15,000 in attorney fees, pre-judgment interest of 18 percent from August 30, 2024, until date of entry of judgment, post-judgment interest of 7 percent from date of entry of judgment until the invoice is paid in full, court costs including post-judgment execution and other relief.

HAVE is being represented by Jerred P. Roth and Harold K. Carpenter of Roth Carpenter PLLC in Parkersburg. The case has been assigned to Circuit Judge Andrew Dimlich.

Late last year, the Justice family announced plans to sell the Resort at Glade Springs.

“When my family purchased Glade Springs in 2010 the future of Glade was in doubt and considering our long association with the property, the founding family and many of the residents it was the right decision to make,” Jay Justice, the senator’s son, said in a message to property owners and others associated with Glade Springs. “We, along with the management, associates, residents, members, and the POA Board have gone through many changes in the past 14 years.”

The family previously had contracted with Pyramid Global Hospitality to manage the resort. In his message, Jay Justice said the family had retained Dallas-based CBRE Group to market the resort and their other properties at Glade.

Jay Justice said the family had been planning to sell the resort “for an extended period … to reduce corporate debt” and to focus on The Greenbrier Resort and mining interests.

Dating back to before Jim Justice was governor and now senator, the Justice family and its companies have a long history of legal and financial troubles that often have intersected in court.
