HUNTINGTON – A class action lawsuit claims employees at a recently closed Barboursville restaurant weren’t paid all of their wages.
Chandra Harmon filed her complaint February 28 on behalf of herself and others similarly situated against Chase & Green Corp. doing business as Buffalo Wild Wings. The company operated a location of the restaurant at the Huntington Mall from 2014 until it abruptly closed earlier this year.
According to the complaint, Harmon began working at the restaurant in April 2024 as a server. In August or September of last year, she says a paycheck issued to her bounced. In earlier February of this year, she said it happened again.
She says she contacted the defendant about the bounce, but has not received timely payment of the past due wages.
And at the end of February, she says Buffalo Wild Wings closed the mall location without prior notice to its employees. Harmon says the company still owes her wages for February.
The complaint says the company has failed or refused to pay all of its employees their full wages for the month of February.
Harmon accuses the defendant of violation of the West Virginia Wage Payment and Collection Act.
The complaint says the potential class would include all current and former employees hired on or after August 1, 2024, at the Barboursville location who have not received timely payment of their earned wages on or after August 1. It says the likely number of members is 30 to 50.
In addition to seeking to have the class certified, the plaintiff seeks compensatory damages, liquidated damages, court costs, attorney fees and other relief.
Harmon is being represented by Hoyt Glazer and Eric Anderson of Glazer Saad Anderson in Huntington. The case has been assigned to Circuit Judge Paul Farrell.
