  • Kanawha Co. apartment owner settles sexual harassment suit

    CHARLESTON – The U.S. Justice Department says the owner and former property manager of a Cross Lanes apartment complex has agreed to settle a sexual harassment lawsuit. Perkins Parke Apartments has agreed to pay $120,000 in damages and civil penalties to settle the suit alleging that three former agents sexually harassed and retaliated against female tenants, which is a violation of the Fair Housing Act (FHA).

    BOSTON – A West Virginia-based law firm has filed a class action lawsuit against Volkswagen over what it calls the deceptive marketing of “clean diesel” engines. The Boston office of Bailey & Glasser LLP filed the action Sept. 24 in federal court in Boston against Volkswagen Group of America.     CHARLESTON – West Virginia Attorney General Patrick Morrisey’s office has filed its own lawsuit against a Putnam County funeral home accused of violating the state’s Preneed Funeral Contracts Act. In the complaint, filed Sept. 18 in Kanawha Circuit Court, Morrisey’s office says Gatens-Harding Funeral Home of Poca and owners Chad and Billie Harding misappropriated money from consumers who were trying to prepay their funeral costs and did not register some preneed funeral contracts with the state

    CLARKSBURG – A Preston County country club says a racial harassment and discrimination lawsuit against it should be dismissed. Preston County Country Club filed a motion last week to have a civil lawsuit filed against it by Jason Goines removed to federal court.

    HUNTINGTON – Walmart seeks to dismiss a Putnam County woman’s complaint in which she blames the retailer for having her Achilles’ tendon sliced while shopping for back-to-school supplies.     WHEELING – The parents of a former Wheeling Jesuit University student have filed a federal lawsuit against the two men who allegedly “viciously attacked” their son, resulting in his death, and the two Wheeling bars that allegedly served the men.     WHEELING – A German pharmaceutical company has filed a patent infringement lawsuit against Morgantown-based Mylan Pharmaceuticals. Plaintiff Boehringer Ingelheim Pharmaceuticals Inc. contends that defendant Mylan submitted Abbreviated New Drug Applications, or ANDAs, to the Food and Drug Administration seeking the approval to make and sell generic versions of Boehringer’s Tradjenta and Jentadueto tablets.     WHEELING - A woman is suing Verizon Wireless after she claims it violated the West Virginia Wage Payment and Collection Act. Ashley Stender was employed by Verizon and worked for the defendant until her employment was terminated on Oct. 1, according to a complaint originally filed in Ohio Circuit Court and removed to federal court. Stender claims the defendant did not pay all owed wages to her until Oct. 17 and Oct. 31.
