Woman blames CAMC for infant's death

CHARLESTON – A woman is suing Charleston Area Medical Center after she claims it is responsible for her infant's death.

West Virginia University Board of Governors is also named as a defendant in the suit.

On May 12, 2013, the defendants began caring for Jillian Barnett and Levi Barnett, during his delivery, according to a complaint filed in Kanawha Circuit Court.

Jillian Barnett claims the defendants were negligent in failing to timely deliver Levi Barnett, despite alarming fetal monitoring strips.

The defendants' negligence, carelessness and recklessness caused Levi Barnett's death on May 19, 2013, according to the suit.

Jillian Barnett claims as a result of the defendants' negligence, carelessness and recklessness, the defendants failed to properly and timely provide medical care and treatment, in violation of the applicable standard of care.

Levi Barnett was forced to endure mental anguish, pain, suffering and loss of enjoyment of life prior to his death, according to the suit.

Jillian Barnett is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Richard Lindsay and Dr. Richard Lindsay of Tabor Lindsay & Associates.

The case is assigned to Circuit Judge Jennifer Bailey.
