Father accuses physicians of medical negligence

WINFIELD – A father is suing two physicians for medical negligence after he claims they failed to timely diagnose his son's problem.

Drs. Flora F. Pacis and Akaber Elkhamra; Flora F. Pacis M.D. Inc. and Logan Pediatrics were all named as defendants in the suit.

Jeremiah Triplett had his first office visit with Pacis on Aug. 4, 2007, five days after birth, and continued with her until March 1, 2011, according to a complaint filed May 14 in Putnam Circuit Court.

John Triplett claims Pacis failed to identify Jeremiah Triplett's undescended testicles and to timely refer him for treatment.

Jeremiah Triplett began treatment with Elkhamra at Logan Pediatrics on March 23, 2012, and she also failed to identify Jeremiah Triplett's undescended testicles and to timely refer him for treatment.

In November 2013, another physician performed a careful and appropriate examination of Jeremiah Triplett and discovered the testicles were not descended into the scrotum, according to the suit.

John Triplett claims an ultrasound was performed to confirm the diagnosis and revealed that the testicles were in the inguinal canal and Jeremiah Triplett had surgery to treat the issue.

Because the defendants did not timely identify and refer Jeremiah Triplett for treatment, his testicles are small, did not develop appropriately, he is at a significantly increased risk for fertility problems, he is at an increased risk of testicular cancer and his hormonal and other development has been impaired, according to the suit.

John Triplett claims the defendants failed to fulfill their duties as professional medical service providers, which caused Jeremiah Triplett to not be provided appropriate and timely medical care and treatment.

John Triplett is seeking compensatory damages. He is being represented by William M. Tiano of Tiano O'Dell PLLC.

The case is assigned to Circuit Judge Phillip Stowers.
