CHARLESTON – A man is suing Technical Staffing Resources after he claims he was discriminated against
Kellogg Brown & Root LLC, KBR Holdings LLC, Kellogg Brown & Root Services Inc., KBR Engineering Company LLC, KBR USA LLC, KBR Construction Company LLC and KBR Building Group were also named as defendants in the suit.
On April 24, Brad Taylor had to undergo back surgery due to health conditions and took an approved heave of absence from work, according to a complaint filed June 5 in the U.S. District Court for the Southern District of West Virginia.
Taylor claims the defendants were aware that he intended to return to work as soon as possible and he worked from home, with the defendants' knowledge, for a number of weeks during recovery and submitted his time sheets and also provided notice that he would be returning to work full time on June 2.
On June 2, Taylor returned to work and presented his release from his doctor and, a few hours later, he was informed he was being laid off because there had been a downturn in the economy and there was no work for him to perform, according to the suit.
Taylor claims although he was informed he was being laid off, his staff continued to work.
The asserted reason for the lay-off was not true and the defendants had posted a job advertisement for the position of lead electrical engineer on May 5, while Taylor was recovering from surgery, according to the suit.
Taylor claims the defendants maliciously and summarily discharged him from his employment based upon his disability and/or perceived disability in violation of the West Virginia Human Rights Act.
As a result of the defendants' actions, Taylor suffered lost wages, emotional distress, humiliation, embarrassment and other damages, according to the suit.
Taylor is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Maria W. Hughes and Mark Goldner of Hughes & Goldner.
The case is assigned to District Judge John T. Copenhaver Jr.
