Fired employee says Highland Hospital didn't pay wages on time

CHARLESTON -- A woman is suing over claims she was not paid her final wages from a hospital on time.



Melissa Burdette, individually and on behalf of those similarly situated, filed a lawsuit Jan. 27 in Kanawha Circuit Court against Highland Hospital Association, citing the West Virginia Wage Payment and Collection Act.

According to the complaint, on Nov. 7, Burdette's employment as a pharmacy technician with Highland Hospital was terminated and the hospital failed to pay her last wages until three days after the next scheduled payday.

Burdette is seeking damages in an amount to be determined by the court.

She is being represented in the case by attorneys Todd S. Bailess and Joy B. Mega of Bailess Law PLLC and Rodney A. Smith and Jonathan R. Marshall of Bailey & Glasser LLP. The case has been assigned to Circuit Judge Charles E. King.
