CHARLESTON -- A man claims he suffered injuries while sitting on an unsecured seat in a KRT bus.
Gregory Price filed a lawsuit April 25 in Kanawha Circuit Court against the Kanawha Valley Regional Transportation Authority.
In his complaint, Price alleges he was riding on a Kanawha Valley Regional Transportation Authority bus that was traveling from South Charleston to St. Albans on Nov. 6. However, the seat was not securely fastened, causing Price to incur both physical and mental injuries, according to the complaint.
Because of the incident, Price suffered severe physical and mental pain and suffering, endured emotional distress and mental anguish and lost his enjoyment of life, the suit states. He also suffered physical impairment, the complaint says.
Price blames the Kanawha Valley Regional Transportation Authority for causing his injuries, saying it breached its duty to properly inspect, maintain and repair the seat and by not providing Price with a safe seat.
Price is seeking an unspecified compensatory damages, plus costs, attorneys’ fees and other relief the court deems just.
He is being represented by Michael J. Del Giudice and Keisha D. May of Ciccarello, Del Giudice and LaFon in Charleston. The case has been assigned to Circuit Judge Carrie L. Webster.
