HUNTINGTON -- A West Virginia woman claims a bank harassed her about a debt she couldn't repay.
Theresa Absten filed a lawsuit May 9 in Cabell Circuit Court against Merrick Bank Corporation, citing the West Virginia Consumer Credit and Protection Act.
According to the complaint, the defendant is a debt collection agency Absten owed money. The suit states the defendant began harassing the plaintiff after Absten's debt went in arrears, even after she obtained legal counsel.
The plaintiff claims Merrick harassed her with letters and phone calls regarding the debt, a violation of the West Virginia Consumer Credit and Protection Act.
Absten is seeking statutory and punitive damages in an amount to be determined by the court.
She is being represented in the case by attorneys Hoyt Glazer, Ben Sheridan and Mitchell L. Klein of Klein, Sheridan and Glazer LC. The case has been assigned to Circuit Judge Christopher D. Chiles.
