Lewis Co. man says former employer didn't pay in timely manner

HUNTINGTON -- A Lewis County man is suing, alleging his former employer took too long in paying his final wages.

Jimmy D. Posey filed suit April 25 in Cabell Circuit Court against Sowards Oil Field Services Inc.

According to the complaint, Posey was an employee of the defendant until Oct. 23, 2012, when he quit. The next pay period following Posey leaving was Oct. 26, 2012, however he did not receive his final pay check until Nov. 5, 2012, the suit states. Sowards Oil Field's failure to pay Posey his final check earlier is a violation of the West Virginia Wage Payment and Collection Act.

Posey is seeking damages in excess of the jurisdictional minimum.

He is being represented by attorney Erika Klie Kolenich of Klie Law Offices PLLC.
