WHEELING -- A local park commission faces a lawsuit after a child was allegedly injured while skating.
Bianca Miller, individually and as mother and next of friend of Kristofer Ryder, a minor, filed suit May 20 in Ohio Circuit Court against Wheeling Park Commission, Murray Sandler Skate and Rink Supply, now known as Arrow Hockey and Sport Corp., Ice Builders and John Doe.
According to the complaint, the plaintiffs were at the Wheeling Park's Memorial Ice Skating Rink on Nov. 4, 2007, which is owned and operated by the defendant commission. Ryder was using an ice walker designed for beginner skaters and manufactured by defendant Arrow Hockey when he tripped on a defect at the rink and fell, severely injuring himself, the suit states.
The defendants are accused of negligence, strict liability, failure to warn, breach of warranties and negligent infliction of emotional distress.
Miller is seeking damages to satisfy the minimum jurisdictional limit.
She is represented by Wheeling attorney Ronald W. Zavolta of Zavolta Law Office. The case has been assigned to Circuit Judge David J. Sims.
