PRINCETON -- A faulty part on an ATV is the alleged cause of an accident and injuries in a Mercer County filing.
James Michael Williams filed suit May 12 in Mercer Circuit Court against Arctic Cat Inc., Arctic Cat Sales Inc., Arctic Cat Production LLC, Arctic Cat Production Support LLC, Arctic Cat Shared Services LLC and Princeton Power Sports ATV & Cycle LLC.
According to the complaint, the plaintiff was injured May 12, 2013, while riding an Arctic Cat XC-450 ATV sold by defendant Princeton Power and manufactured by the other named defendants. Following the accident, the plaintiff discovered that model of ATV had been recalled Nov. 10, 2011, because of poorly designed tie rods, the suit states.
An investigation after the accident determined the ATV's crash was the result of a bent tie rod, according to the suit.
The defendants are accused of strict liability, negligence and breach of warranty.
Williams is seeking damages, pre- and post-judgement interest, attorney's fees, costs and any other relief the court deems just.
He is represented by Princeton attorney Derrick W. Lefler of Gibson, Lefler & Associates. The case has been assigned to Circuit Judge Derek C. Swope.
