PRINCETON -- A trucking company is being sued after a passenger allegedly fell out of a moving truck and suffered serious injuries.
Erika Ball filed suit April 29 in Mercer Circuit Court against Cundiff Trucking Inc.
According to the complaint, on Nov. 20 Ball was a guest passenger in a truck owned by the defendant, riding in the left side of the cab directly behind the driver in the sleeper bunk. When the driver entered a ramp to Interstate 77 Ball and a tool box above her suddenly shifted and made contact with the sleeper cabin's left door, which opened and ejected Ball from the moving vehicle, the suit states. Ball suffered a traumatic brain injury, a skull fracture, sinus fracture and spinal fractures, among other injuries, according to the suit.
Ball is seeking compensatory damages in an amount to be determined by the court, attorney's fees and costs and any other relief the court deems just.
She is represented by Princeton attorneys Ryan J. Flanigan and William Flanigan of Sanders, Austin, Flanigan & Flanigan. The case has been assigned to Circuit Judge Omar J. Aboulhosn.
