Man says Ford should pay for truck repairs

PRINCETON -- A Mercer County man is suing Ford, claiming the truck he purchased required multiple repairs that should be covered under warranty.

Frederick Browning filed suit April 29 in Mercer Circuit Court against Ford Motor Company.

According to the complaint, on Dec. 21, 2012, the plaintiff bought a 2013 F-250 Super Duty truck manufactured by the defendant with a three-year/36,000-mile warranty.

On April 29, 2013, the plaintiff returned the vehicle to the dealership he purchased it from with numerous concerns, including a popping noise and apparent brake issues, the suit states. The dealer repaired the issues, but Ford refused to pay the repair costs under the warranty.

Repairs had to be completed on the vehicle again Oct. 16, and again Ford denied payment of the repair costs, claiming the repairs were needed due to the plaintiff negligently maintaining the vehicle.

The defendant is accused of breaching expressed and implied warranties through their refusal to pay for the repair costs to the vehicle.

Browning is seeking a refund of the purchase price of $54,725.08, a refund of monies spent on repair costs totaling $5,341.32, and damages of not less than $10,000, plus costs.

He is represented by Princeton attorney William O. Huffman. The case has been assigned to Circuit Judge Derek C. Swope.
