NEW CUMBERLAND – A Weirton grocery store is being sued after a customer allegedly tripped and fell over a cart.
James Hill and Robin Hill filed suit June 6 in Hancock Circuit Court against Bobette Enterprises Inc., doing business as Weirton Shop-N-Save, and John and Jane Doe(s).
According to the complaint, on July 21, 2012, James Hill was shopping at the defendant's store at 273 Penco Road, Weirton, when he fell over a cart that had been left unattended in an aisle, sustaining severe injuries. The defendants are accused of failing to maintain the area in a reasonably safe manner, allowing the area to be in an unsafe manner and failing to take reasonable precautionary measures.
The Hills are seeking compensatory and general damages within the jurisdictional limit.
They are represented by Weirton attorney Dean G. Makricostas of Dittmar, Taylor & Makricostas PLLC. The case has been assigned to Circuit Judge Ronald E. Wilson.
