FAYETTEVILLE -- A former employee of a Montgomery hospital is suing because he was allegedly refused work after taking a leave of absence.
Bobby G. Fowler filed suit June 10 in Fayette Circuit Court against Montgomery General Hospital Inc.
According to the complaint, Fowler began working for the defendant in 1973 and continued in various capacities until suffering two stokes in July 2012. After taking a medical leave of absence, the plaintiff informed Montgomery General he would be available for work again beginning Jan. 1, 2014, and submitted an application in April, the suit states.
To date, the defendant has not contacted Fowler regarding any openings nor responded to Fowler's inquiries, despite evidence the defendant has had need for additional employees, according to the suit.
Fowler is accusing the defendant of discrimination based on disability and age discrimination.
Fowler is seeking actual damages, lost compensation, compensatory damages, punitive damages, attorney fees and costs.
He is represented by Huntington attorneys Hoyt Glazer, Ben Sheridan and Mitchell L. Klein of Klein, Sheridan and Glazer LC. The case has been assigned to Circuit Judge John W. Hatcher.
